These Terms of Service (“Terms”) govern your access to and use of our product portal (the Site) and your purchase of headphones, earbuds, headsets, audio accessories, and related consumer electronics offered on the Site. By using the Site or placing an order, you agree to these Terms and our Privacy Policy and Return & Refund Policy. If you do not agree, do not use the Site.

2. Eligibility & account
You must be able to form a binding contract under the laws of your place of residence. You agree that registration and order information you provide is accurate and kept up to date. You are responsible for safeguarding your account credentials and for all activity under your account.
3. Products & descriptions
We sell audio products and related accessories. Product titles, images, specifications (for example Bluetooth version, battery life, water-resistance ratings, compatibility with iOS/Android), and prices are provided for general information. We try to keep listings accurate, but:
· Colors and finishes may vary slightly due to display settings;
· Feature claims (noise reduction, waterproof ratings, battery hours, etc.) are based on manufacturer or supplier information and typical use — actual performance depends on device, environment, and usage;
· Compatibility statements are guidance only; you are responsible for confirming connector type, Bluetooth profile, and OS support before purchase;
· We may correct errors, update specifications, or withdraw products at any time before we accept your order.
4. Orders, pricing & payment
Placing an order is an offer to buy. We may accept or decline an order (for example due to stock, pricing error, suspected fraud, or shipping restrictions). A contract is formed when we send an order confirmation. Prices are as shown at checkout in the selected currency, exclusive or inclusive of tax as displayed. Payment must be completed through the methods we offer at checkout. Title to goods passes when we receive full payment and risk of loss passes when we deliver the goods to the carrier, unless mandatory law provides otherwise.
5. Shipping
Delivery estimates (commonly about 7–15 business days after dispatch, depending on destination) are estimates only. See our Shipping Information page for coverage, fees, and tracking. Delays caused by customs, carriers, incorrect addresses, or force majeure are outside our reasonable control.
6. Returns, refunds & warranties
Returns and refunds are governed by our Return & Refund Policy. Nothing in these Terms limits non-excludable rights under applicable consumer protection law (including Malaysian consumer law where it applies). Except as required by law or expressly stated, products are provided with manufacturer specifications “as described,” and we do not warrant uninterrupted fitness for a particular professional use (for example broadcast, medical, or industrial applications) unless the listing expressly says so.
7. Acceptable use
You agree not to:
· Use the Site for unlawful, fraudulent, or abusive purposes;
· Scrape, crawl, or harvest data from the Site with automated means except as allowed by robots.txt or our prior written consent;
· Interfere with Site security or infrastructure;
· Upload malware or infringing content;
· Misrepresent affiliation with Electrowells or third-party brands shown on product listings.
Brand names appearing in product titles may be used to describe compatibility or product type and remain the property of their respective owners.
8. Intellectual property
Site content (layout, text, graphics, logos, and software) is owned by us or our licensors and protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to access the Site for personal shopping use. You may not copy, resell, or commercially exploit Site content without our written permission.
9. Disclaimers
To the fullest extent permitted by law, the Site and its content are provided on an “as is” and “as available” basis. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Product advice on the Site does not replace your own evaluation of suitability for your device and use case.
10. Limitation of liability
To the fullest extent permitted by applicable law, we and our directors, employees, and suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Site or products. Our aggregate liability for any claim relating to an order is limited to the amount you paid for the product(s) giving rise to the claim, except where liability cannot be limited by law (including liability for death or personal injury caused by negligence, or fraud).
11. Indemnity
You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Site, your breach of these Terms, or your violation of any law or third-party rights.

Our collection and use of personal data is described in our Privacy Policy. By using the Site, you acknowledge that policy.
13. Force majeure
We are not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, epidemic measures, embargoes, utility or network failures, or carrier disruptions.
14. Governing law & disputes
These Terms are governed by the laws of Malaysia, without regard to conflict-of-law rules. Courts of Kuala Lumpur, Malaysia shall have non-exclusive jurisdiction, without prejudice to any mandatory consumer rights you may have in your country of residence (including the right to bring proceedings in your local courts where required by law).
15. Changes
We may update these Terms by posting a revised version on the Site with a new “Last updated” date. Continued use of the Site after changes constitutes acceptance of the revised Terms.
